2. HOW TO ENTER:
It’s time to start Saucin’ Up Jacksonville and it starts in your backyard! Pick up some of Garland Jack’s SECRET SIX Barbecue Sauce, grab a few of your best buds and get Saucy!! We want to know how you sauce up your BBQs and make them extra special. Enter to win by submitting your tips, secrets (if you dare!) and knowledge of BBQing. Your tip or secret might even be read live by the DJ for all to start using. DJs will encourage listeners log on the web and submit your tips, secrets and knowledge of BBQ for their chance to win!
3. ELIGIBILITY: The “Sauce Up Jacksonville” contest is open only to Florida Residents only who are 18 years of age or older at the time of entry and who have not won any other on-air or on-line contest from WAPE-FM or WAPE.com in the past 30 days. One entry per person. Employees of Cox Enterprises, Inc., Cox Radio, Inc., any other radio stations, promotional sponsors, and all affiliated companies (and the immediate family members of all such employees, and all other with whom they are domiciled) are not eligible to participate in the contest or win the prize. The term, immediate families include spouses, grandparents, siblings, children, and grandchildren. No Purchase Necessary.
4. PRIZES: One (1) grand prize winner will receive a $250 Amex/Visa Gift Card. Winner shall be notified via email and/or phone and must pickup their prize within 10 business days of notification or before close of business on date of ticketed event at 8000 Belfort Parkway, Jacksonville, FL. If the prize is not claimed by that time, it will be forfeit and Cox Radio shall not bear any responsibility for failure of Winner to provide verification of their eligibility by that deadline. ALL Prizes need to be awarded to Florida residents ONLY. No Purchase Necessary.
5. ODDS: The odds of winning a prize depend on the number of qualified entries submitted by people attempting to participate in the contest at any given time.
6. WINNER NOTIFICATION AND ACCEPTANCE: Grand Prize winner will be chosen randomly at the end of the flight from all contest entries. No Purchase Necessary. The Prize is non-assignable and non-transferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and WAPE-FM reserves the right to substitute prizes of equal or greater value. Some elements of the prize are not available for general purchase and therefore have no value. The Winner is solely responsible for the reporting and payment of any taxes on prizes. As a condition of receiving the contest prize, the Winner will be required to complete an affidavit of eligibility and a liability and publicity release, which must be signed at the time the winner claims his/her prize at the WAPE-FM Business Office. Failure of to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of WAPE-FM, and Cox Radio, Inc., result in winner's disqualification, the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Contest constitutes the Winner's consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from WAPE-FM, and Cox Radio, and on the Cox Radio Interactive Web sites, and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation. 7. PARTICIPATION: Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules. WAPE-FM, and Cox Radio, Inc. reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest. WAPE-FM reserves the right to alter, modify, or cancel the contest at any time for any reason.
8. LIMITATIONS OF LIABILITY: By entering the Contest, contestant agrees that (1) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (3) under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all rights to claim punitive, incidental or consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
9. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestant and Cox Radio, Inc. in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Florida. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
10. GENERAL RELEASE: By entering the Contest, contestants release WAPE-FM, Cox Media Group, KRAFT Garland Jack’s, and TMPG, any other promotional sponsors, and each of their respective parents, affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).
11. The “Sauce Up Jacksonville” contest is sponsored by WAPE-FM, Cox Media Group, Inc., whose decisions regarding the selection of winners and all other aspects of Contest shall be final and binding in all respects. WAPE-FM, and/or Cox Media Group, Inc., will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials. By participating, entrants agree (a) to release, discharge and hold harmless The DANNON Company, Inc., TMPG Media Innovation, Publix and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this sweepstakes, and the respective directors, officers and employees of the foregoing (collectively, the “Released Parties”) from any liability, claims, losses and damages arising, in whole or in part, directly or indirectly, out of or relating to their participation in this sweepstakes and the acceptance, use, misuse or possession of the prize, and any injury or harm resulting from any of the foregoing or any use of the prize received in this sweepstakes); (b) to abide by these Official Rules and that decisions of Sponsor and judges shall be final and binding in all respects; and (c) if a winner, to the use by Sponsor and its designees of his/her name, city and state of residence, photograph, voice and/or likeness, and prize information for purposes of advertising, promotion and trade in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law; and, upon request, to provide consent to such use in writing; (d) the Released Parties are not responsible for any inability of the winner to accept or use prize for any reason; (e) any dispute that arises regarding the meaning or interpretation of the Official Rules shall be resolved by applying the laws of Florida without regard to conflict of law provisions therein, and shall be solely and exclusively brought in the state or federal courts located within that state; and (f) the Sponsor may disqualify (and void all associated sweepstakes entries) anyone from participating in the sweepstakes or winning the prize if, in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the sweepstakes by cheating, deception or other unfair playing practices, or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who is otherwise not in compliance with the terms of these Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
